Terms of Service

The service

PokeNotify is an independent tool that monitors trading-card-game product availability and sends you alerts based on the regions, retailers, and games you follow. We are not affiliated with, endorsed by, or sponsored by any retailer or card-game publisher. We do not sell products, hold inventory, or guarantee that any product will be available when you receive an alert.

Eligibility and accounts

You must be at least 13 years old to use PokeNotify. You are responsible for the activity under your account and for keeping your sign-in credentials secure. You agree to provide accurate account information.

Subscriptions and billing

• PokeNotify offers an auto-renewing subscription. Pricing and any free trial are shown in the app before you purchase.
• On iOS, payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

Acceptable use

You agree not to:

• Use the service to violate any law or any retailer’s terms.
• Scrape, resell, or redistribute our alerts or data, or attempt to access the service through unauthorized automated means.
• Interfere with, disrupt, or attempt to gain unauthorized access to the service or its infrastructure.

No warranty

The service is provided “as is” and “as available.” Alerts may be delayed, incomplete, or inaccurate, and products may sell out before you can act. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, PokeNotify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any missed purchase, lost profit, or lost opportunity arising from your use of (or inability to use) the service.

Termination

You may stop using the service and delete your account at any time from the app. We may suspend or terminate access if you violate these terms or to protect the service.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the service after an update means you accept the revised terms.

Governing law

These terms are governed by the laws of the United States and the state in which PokeNotify LLC is organized, without regard to conflict-of-laws rules.
