Giveaway Terms & Conditions

NO PURCHASE OR PAID MEMBERSHIP IS NECESSARY TO ENTER OR WIN. The mail entry method below is available without buying a subscription, earning Sparks, or redeeming Sparks. Ordinary postage costs apply. All valid entries have the same weight in winner selection, regardless of entry method. Void where prohibited by law.

1. Sponsor and scope

PokeNotify LLC (“PokeNotify”, “Sponsor”, “we”, or “us”) sponsors and administers PokeNotify giveaways unless a different sponsor or administrator is expressly identified. Our correspondence address is 4801 McKnight Road #1075, Pittsburgh, PA 15237, United States. Contact us at support@pokenotify.com.

These terms apply together with the applicable giveaway listing or announcement (“Giveaway Details”). The Giveaway Details identify the giveaway’s name, entry period and time zone, mail postmark and receipt deadlines, available entry methods and limits, prizes and approximate retail values, selection procedure, and notification and delivery schedule. Any additional eligibility restrictions or regional prize allocations must also be disclosed before entry. You can review these terms without purchasing a subscription.

Conditions specific to a giveaway apply only when clearly disclosed in its Giveaway Details before entry and permitted by law. They do not override the no-purchase entry requirement, equal treatment of entry methods, or mandatory consumer protections. By participating, you agree to these terms and the applicable Giveaway Details.

2. Eligibility

Unless the Giveaway Details specify a narrower eligible area, giveaways are open to legal residents of the United States (the 50 states and the District of Columbia), Canada, and the United Kingdom (England, Scotland, Wales, and Northern Ireland). At the time of entry, you must be both at least 18 years old and have reached the age of majority in your state, province, territory, or country of residence. Meeting the minimum age for a PokeNotify account does not establish giveaway eligibility.

Employees, officers, and directors of Sponsor and anyone directly involved in administering a giveaway are ineligible, as are their immediate family members (spouse or partner, parents, children, and siblings) and members of their households. Use your own accurate information and a PokeNotify account email you control. A free account is sufficient for mail entry; no paid subscription, trial enrollment, payment information, marketing consent, or social media follow is required for that method.

Sponsor may request reasonable evidence of identity, age, residence, and compliance before awarding a prize. Recording an account entry or confirming eligibility in the app does not by itself establish eligibility to receive a prize.

3. Entry periods and deadlines

Each giveaway’s opening and closing dates, time zone, mail deadlines, and selection schedule are stated in its Giveaway Details. App entries must be successfully recorded during the stated entry period. Mailed requests must meet both the stated postmark and receipt deadlines. Sponsor will allow the published mail receipt period to expire and process valid mailed entries before selecting winners.

Sponsor’s server records determine app entry times. Postal-service postmarks and Sponsor’s receipt records determine mail timeliness. Allow enough time for international delivery. Expedited, tracked, or certified postage is not required. Entries for one giveaway do not carry over to another giveaway.

4. No-purchase entry by mail

To enter without a purchase, write or print the following legibly on a postcard or a sheet of paper:

• Your full legal name.
• Your complete mailing address, including country and ZIP or postal code.
• The email address associated with your PokeNotify account.
• The name of the giveaway you wish to enter.

Mail the postcard, or the sheet in an envelope, with sufficient ordinary postage to the address below. If the Giveaway Details specify an attention line for that giveaway, include it on your mailing.

Each complete, valid, timely mailed request receives one entry. Send one request per postcard or envelope. Unless the Giveaway Details state an overall per-person entry limit, you may send multiple separate requests. Any overall per-person entry limit applies equally across entry methods. You do not need to include money, a receipt, Sparks, a subscription number, a return envelope, or proof of purchase. A valid mail entry does not depend on Premium status or a Sparks balance and is included in the same selection pool as app entries.

Requests must be submitted by the entrant for themselves. Incomplete, illegible, postage-due, misaddressed, or untimely requests are invalid. Mailed materials will not be returned. Any additional no-purchase entry method will be explained in the Giveaway Details. Contact Sponsor for help with the instructions or an accessible copy of these terms.

5. App entries, Premium, and Sparks

• Premium’s included entry. Where offered in the Giveaway Details, eligible accounts with active Premium access, including eligible trials, receive one automatic entry during the entry period. The limit is one included Premium entry per person per giveaway. Renewing, upgrading, or holding more than one subscription does not create additional included entries. A valid recorded entry survives later membership expiration.
• Sparks entries. Where offered, open the giveaway in PokeNotify Rewards and follow the on-screen instructions to redeem available Sparks. The Sparks cost per entry and applicable limits are disclosed before redemption. Confirm your eligibility, acceptance of these terms, entry quantity, and total Sparks cost. Only a successful recorded redemption counts.

Valid entries from available methods may be combined, subject to any published overall per-person limit. Sparks are rewards points, not a cash prize or a guarantee of winning. An unsuccessful entry does not entitle you to a return of Sparks. No Sparks are required for mail entry, and a paid subscription is not necessary to participate through that method.

Entries belong to one person and cannot be sold, transferred, or pooled. Do not use multiple accounts, another person’s identity, bots, or fraudulent activity to obtain entries or Sparks. Legitimate separate mail requests are permitted subject to the published entry limit. Sponsor may disqualify entries supported by evidence of fraud or noncompliance, subject to applicable law.

6. Prizes and winner selection

The Giveaway Details identify the number, description, and approximate retail value of the prizes, the currency used, and any regional allocation. Unless otherwise disclosed before entry, each valid entry counts toward all prizes in that giveaway, with a maximum of one prize per person per giveaway. Prizes are awarded in the order and manner stated in the Giveaway Details.

Potential winners are selected using a verifiably random computer process or a random draw conducted or supervised by an independent person. All valid app and mail entries must be included before selection. Each entry has equal weight, regardless of entry method or membership status. An entrant’s chance of selection depends on their number of valid entries, the total valid entries received, the number of prizes, and any entrants already selected. Additional valid entries increase an entrant’s chance of selection; no fixed odds or guaranteed win are promised.

Once a person is selected for a prize, all of that person’s entries are excluded from selection for remaining prizes where the one-prize limit applies. Selection identifies a potential winner only; a prize is awarded after eligibility and claim requirements are verified. If a potential winner is ineligible, declines, fails the applicable skill question, or does not complete the claim requirements, Sponsor may select an alternate at random from the remaining eligible entrants.

No cash alternative or transfer by a winner is available unless the Giveaway Details expressly provide otherwise. If a prize becomes unavailable for reasons beyond Sponsor’s reasonable control, Sponsor may provide a reasonably equivalent prize of equal or greater value, where lawful, and will inform the affected winner. Actual retail values and exchange rates may vary; differences in value will not be paid.

7. Notification and claiming a prize

Sponsor will contact potential winners through their PokeNotify account email and may also provide an app notification. The selection, notification, and response deadlines are stated in the Giveaway Details. Keep your email current, check spam folders, and respond by the published deadline. Sponsor will provide a reasonable extension when required by law or needed for an agreed accessibility accommodation.

Verification may include proof of age and residence, confirmation of account ownership, delivery information, and legally required tax documentation. Sponsor will collect only information reasonably needed to verify eligibility and fulfill the prize. An undeliverable notification or failure to respond or complete verification by the stated deadline may result in forfeiture and selection of an alternate.

Sponsor will never require you to buy a subscription or send payment to Sponsor to claim a prize. If you are unsure whether a winner message is authentic, contact support@pokenotify.com.

8. Canadian winners

Before receiving a prize, a selected Canadian resident must correctly answer a time-limited mathematical skill-testing question without assistance from another person, a calculator, or other calculating aid. Sponsor will administer the question at an arranged time and communicate the time limit beforehand. Reasonable accommodations required by applicable law will be provided. An incorrect answer or failure to complete the question results in disqualification from the prize and selection of an alternate under these terms.

9. Delivery, costs, and taxes

Sponsor will arrange and pay for ordinary shipping to a verified winner’s address in an eligible country, including import duties and customs charges necessary for delivery. No shipping or handling fee is payable to Sponsor to receive a prize. Winners are responsible for any personal income taxes or reporting obligations that applicable law places on them. Sponsor will complete any reporting or withholding required of Sponsor.

The Giveaway Details state the prize delivery schedule. Sponsor will award prizes promptly, normally within 30 days after the closing date unless a later delivery date is disclosed before entry. Sponsor will communicate unavoidable delays and provide a lawful remedy. Winners must provide a deliverable address and cooperate with reasonable delivery arrangements.

10. Privacy, winner information, and publicity

Sponsor uses entry and verification information to administer giveaways, prevent fraud, contact potential winners, fulfill prizes, and meet legal obligations, as described in the Privacy Policy. Information may be shared with service providers that assist with these purposes and authorities when legally required. Records are retained only as reasonably necessary for these purposes and applicable legal requirements. Contact Sponsor to exercise applicable privacy rights.

Entering does not subscribe you to marketing messages. Sponsor will obtain separate consent where required for optional marketing or use of a winner’s photo, testimonial, or likeness. Such optional consent is not a condition of receiving a prize.

To demonstrate that prizes were validly awarded, Sponsor may make available confirmed winners’ surnames and county, province, or state, and country. Entrants may contact Sponsor before publication to object or request that the information disclosed be reduced. Sponsor will respect applicable privacy law and may still provide award evidence to a regulator, including the UK Advertising Standards Authority, if required. Full addresses, account emails, and identity documents will not be published.

To request confirmation of winners, email support@pokenotify.com or write to the correspondence address above, identifying the giveaway and marking the request “Winners.” Requests may be made for 90 days after prizes have been awarded, subject to these privacy protections and any longer period required by law.

11. Fair administration and changes

Sponsor will administer giveaways fairly and retain appropriate entry and selection records. A technical problem, postal disruption, fraud, or other circumstance beyond Sponsor’s reasonable control may require a lawful suspension, modification, or cancellation. Sponsor will communicate material changes through the affected Giveaway Details and take reasonable measures to protect entrants, including returning Sparks redeemed for a canceled giveaway.

Sponsor will not change closing dates merely because too few or too many people entered, or retrospectively impose a new material eligibility condition. A necessary date change will be made only where lawful and without unfairly disadvantaging people who entered or tried to enter under the original terms. Any replacement selection procedure must treat valid entry methods equally.

Updates to these general terms will be reflected in the “Last updated” date. Material changes apply to future giveaways and do not retrospectively change an existing giveaway’s terms except where a lawful change is necessary under the provisions above. Entrants may retain a copy of the terms and Giveaway Details applicable to their entry.

12. Responsibility and legal rights

To the extent permitted by applicable law, Sponsor is not responsible for entry failures or delays caused by postal services, networks, or devices outside Sponsor’s reasonable control, or inaccurate information supplied by an entrant. This does not excuse Sponsor from recording valid entries or administering a giveaway fairly.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer right that cannot lawfully be excluded or limited. Mandatory consumer protections in your place of residence continue to apply.

Subject to those mandatory protections, these terms are governed by Pennsylvania law. This choice does not deprive an entrant of rights or access to courts available under applicable law in their place of residence. If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful.

13. Independent promotion and contact

PokeNotify giveaways are not sponsored, endorsed, administered by, or associated with Apple, Google, Discord, Meta, Instagram, X, The Pokémon Company, Nintendo, or GAME FREAK, unless an applicable partner is expressly identified in the Giveaway Details. Product names and trademarks belong to their respective owners. References to platforms or products do not imply an affiliation.
